Truth, transparency, and integrity.
The compromising of these virtues may be the cost of doing business in our nation but make no mistake the price we collectively pay is enormous. Whether in Washington or on Wall Street, the ability to compromise our prized virtues has truly been raised to an art form.
From derivative transactions which disguise unprecedented levels of risk to bond indentures which require advanced legal degrees to interpret, our ‘friends’ on Wall Street with assistance from ‘their’ friends in Washington have displayed little regard for the aforementioned virtues which are the foundation for real ‘sense on cents’.
More often than not,though,the violation of our virtues is viewed in an impersonal light. Wall Street and Washington are behemoths. The American public and investors at large are faceless. In my opinion, our financial services industry and government would just as soon keep it this way.

Let it be known that with this commentary the Sense on Cents Hall of Shame inducts Senator Jon Kyl (R-AZ), Senator Jeff Sessions (R-AL), and House Speaker John Boehner (R-OH). What have they done to deserve this “honor”? A recent release points the finger squarely at them for assaulting our prized virtues and never ending pursuit of truth, transparency, and integrity. Let’s navigate.
This past January 10th, I inquired Which U.S. Senator Blocked the Whistleblower Protection Enhancement Act? and wrote:
Let’s bang the drum once again to promote truth, transparency and integrity. In this rendition, let’s collectively work to expose the Congressional coward, that is the United States Senator, who blocked the Whistleblower Protection Enhancement Act. In the process, Senator “Coward” took a stand against our prized virtues while defending the monied interests of corporate elitism.
Did you just vomit thinking that our hallowed halls upon Capitol Hill are populated with such louts? Why haven’t others on Capitol Hill raised a hue and cry? Fellow cowards? You think? Getting their bread “buttered” in the process? You think? What happened to our country? (more…)

The Project on Government Oversight has become the financial regulatory eyes and ears for our nation. While one would think Congress might care to thoroughly investigate government agencies and hold them to account, our recent history has shown us that the Congressional oversight is severely lacking. Enter POGO. What has POGO provided us now?
By utilizing the Freedom of Information Act, POGO has provided a huge window of transparency into the SEC. Why should POGO have to perform these acts? Where is the Congressional oversight? Heck, where is the SEC chair Mary Schapiro?
I strongly encourage readers to save this commentary as POGO provides links to a wealth of amazing stories and investigations. THANK YOU POGO for performing a national public service in opening the windows into the SEC. (more…)

Is it possible that our nation can experience a historic demise in our economy and markets with little if any criminal activity involved in that process? Was our economic and market meltdown largely ‘a perfect storm’?
I do not buy those who would put forth that line of reasoning. Nor do I think should you.
Does it defy logic to think that our nation has been hit with trillions of dollars in losses and untold economic pain but only a relative handful of individuals were involved in criminal behaviors connected to this turmoil? Yes, that does defy logic.

I detest those people and organizations paying mere lip service to issues needing real transparency and accountability.
I love having the voice provided by Sense on Cents so I can highlight a wide array of these issues and so people can more effectively navigate the economic landscape. I also love being able to ask the hard questions and call out those whom I think are not serving the public interest.
What else do I love? I love when a voice far stronger than my own echoes my thoughts, shares my opinion, and blasts away in pursuit of real truth, transparency, and integrity along our economic landscape.
With only a few exceptions, the media as a whole has shown itself unwilling to truly take the gloves off and go after the aforementioned ‘lip serving’ individuals and institutions. Independent watchdogs in pursuit of good government are far more aggressive.
On this note and against this backdrop, I have to admit my adrenaline picked up yesterday. How so? Let’s navigate as I was informed of the following: (more…)

Saturday morning in America and life is good.
Yesterday, I gave major props to our great American Gary Aguirre for addressing critically important issues embedded in the recently enacted Financial Regulatory Reform package which allows further FOIA (Freedom of Information Act) exemptions by the SEC. (Aguirre wrote a fabulous dissertation in the September Wall Street Lawyer, which I embedded in my commentary.) I qualified yesterday’s commentary, Great American Gary Aguirre “Cross Examines” in re: SEC’s FOIA Exemptions, as perhaps the most important and enlightening ever put forth at Sense on Cents. I truly believe that. Gary Aguirre is a great American.

Washington and Wall Street are skilled at utilizing smoke and mirrors to advance their collective agenda. The simple fact is most of our Washington operatives do not understand basic financial concepts. The reality of the situation is that our supposed leaders are content to remain blind to the realities of finance as long as Wall Street continues sending campaign funds their way.
Fortunately, others in our nation take a more impassioned view of the world and aggressively question where Washington often passes. To this end, I thank a friend who shared the following letter highlighted today at the Project on Government Oversight on our new favorite topic about the lack of transparency at the SEC.
This letter is comprehensive in addressing a number of critically important points. Do you ever wish that we could have representatives from these organizations questioning not only our elected officials, but also our appointed officials such as Mary Schapiro? I wish that all the time. Please take a few minutes to ponder the issues embedded in this letter. Ask yourself whom you really believe are protecting your interests.

Pursuing the truth does not come from asking softball questions and allowing those being questioned to duck and weave. Regrettably, America has received far too little of the truth throughout our economic crisis. Why? Very simply, the overwhelming stench emanating from the Wall Street-Washington incestuous relationship very frequently suffocates any chance of the truth seeping out. Where can we turn?
Let’s visit our friends at POGO, that is the Project on Government Oversight. This not-for-profit government watchdog has no problems asking the hard questions. In light of my commentary last evening on Mary Schapiro, I was pleased that a friend of Sense on Cents brought to my attention a series of questions directed at SEC Chair Mary Schapiro.

Regular readers of Sense on Cents are well aware of the multiple issues I have highlighted regarding Wall Street’s self-regulatory organization, FINRA. Allegations of front-running the auction-rate securities market, allegations of investing its own funds in Madoff, misrepresentations (i.e. lying in a proxy statement) in the document used for the very formation of the FINRA organization, and ultimately an incestuous relationship with the industry, I have not been bashful in highlighting what I deem to be critical failings, if not potentially much worse, within this organization.
A good friend of Sense on Cents, Ronnie Sue Ambrosino (who just so happens to be a lead spokesperson for Madoff investors), shared a very interesting commentary regarding FINRA. The writer, Ron Rhoades, offered his thoughts on FINRA yesterday at RIABiz, a website which promotes itself as providing “voice, news, and vision for the advisory (registered investment advisors) community.”
Ron holds nothing back in addressing the question of the fiduciary standard within investment management. (more…)
